The applicant hereby under takes to comply
with all the requirements as mentioned below: |

1. |
The applicant applies for certification of the above
mentioned location and requests FoodCert India Pvt Ltd at Quality House, Plot.No:452,
H.O.:8-2-601/P/6, Panchavati Colony, Road.No:10, Banjara Hills, Hyderabad-500034,
India, herein after called as FCI, to carry out an inspection in order to grant
the certificate

FCI, to carry out an inspection in order to grant
the certificate 2. To be familiar with the certification procedure and the certification
scheme for which application has been made.
|
|
3. |
To refrain from any publicity to this certification
application as long as the certificate has not been granted |
|
4. |
Not to file any suit or claim against FCI or its
assessors for any monetary recoveries or for any other damages of any nature whatsoever,
which the applicant suffers as a result of not granting the certificate or as a
result of the failure by FCI in dealing with this application, for the reasons beyond
the control of FCI |
|
5. |
To agree that FCI shall not be liable to the applicant
in any respect if it is prevented from discharging such obligation arising out of
this application, as a result beyond the control of FCI |
|
6. |
To agree with the Letter of Offer made by FCI and
to pay the mentioned/agreed amount in advance before the inspection and certification
are carried out. |
|
7. |
All travel expenses including boarding and lodging
expenses for the inspection activity shall be arranged and shall be born by the
applicant in addition to the fees charged towards application, inspection and certification |
|
8. |
Disputes if any arising out of this application
between FCI and the applicant shall be subject to the Jurisdiction of courts in
the city of Hyderabad, India |
|
9. |
Agree that application charges / inspection charges
paid under this application shall not be refundable to the applicant and these expenses
stands as forfeited incase the applicant is not granted with the certificate/ withdraws
from the contract.
|
|
10. |
Agree that the inspection body can schedule inspection
based on the availability of the inspectors. |
|
11. |
To comply with any additional requirements as may
be stipulated or required by FCI basing on the scheme requirements being assessed. |
|
12. |
To be familiar with and to accept that with the
underwriting of this application form a mutual agreement has been engaged with the
FCI for a period of 3 years continuously unless valid reasons are mentioned for
switchover/withdrawal. |
|
13. |
Agree to inform APEDA & the respective commodity
board and previous Certification Body when the operator changes certification body. |
|
14. |
Agree not to switch in and out of the Certification
System for a minimum period of 3 years. |
|
15. |
To confirm that I have not applied to any other
inspection body for the Scheme for the current crop. |
|
16. |
16. Make no use of FCI / Accreditation bodies logos
or statements inferring to registration, with the scope which could be misleading
or unacceptable to FCI and in such an event, registration can be suspended by FCI.
|
|
17. |
Upon successful registration agree to have its name,
location and scope of application including in FCI, Directory of Registered Customers. |
|
18. |
Upon suspension/withdrawal of its certification,
discontinue use of all material indicating that it is registered for the scheme
and return original copy of certificate as required by FCI |
|
19. |
Maintain all records of complaints relating to products
compliance and to take appropriate actions and to make available to FCI, when requested,
the records of all complaints and corrective actions taken |
|
20. |
To allow personnel from accreditation bodies to
accompany FCI assessors for witnessing the assessments |
|
21. |
Agree to enter into such certification agreement
as may be required by FCI before or at the time of granting of certificate |
|
22. |
To use certification only to indicate as being in
conformity with the scheme being registered |
|
23. |
Agree to follow the requirements of FCI while making
reference to its certification program in its communications via media etc |
|
24. |
Agree to inform FCI in case of any significant changes
affecting the products design or specification or changes in the management/ownership
or changes in the certification system.
|
|
25. |
Allow FoodCert personnel to draw the samples for
pesticide residue analysis and agrees to pay the prescribed analysis charges. |
|
26. |
Agree for the sanctions if any imposed by FCI in
the event of non-compliances by the group and / or by individual operators and the
sanctions may include withdrawal of certification of the whole group
|
